Work Permit FAQ Malaysia — Employment Pass Questions | WPED

Question 1

What is an Employment Pass and who needs one?

Accepted Answer

An Employment Pass (EP) is a work authorisation issued by the Malaysian Immigration Department to foreign nationals employed in Malaysia. It is required for any expatriate taking up employment with a Malaysian-registered company. The EP is categorised into Category I (salary RM10,000 and above), Category II (RM5,000–RM9,999), and Category III (RM3,000–RM4,999), each with different eligibility criteria and validity periods.

Question 2

What are the eligibility requirements for an Employment Pass?

Accepted Answer

Eligibility depends on the category applied for. Generally, the applicant must hold a recognised degree or professional qualification relevant to the position, meet the minimum salary threshold for the category, and be employed by a company that holds a valid expatriate post approval from the relevant authority (e.g. MDEC, MIDA, or the Immigration Department). The employer must also demonstrate that the role cannot be filled by a local candidate.

Question 3

How long does an Employment Pass application take?

Accepted Answer

Processing times vary depending on the approving authority and completeness of the application. As a general guide, applications submitted through MDEC or MIDA typically take 2–4 weeks once all documents are in order. Applications processed directly through the Immigration Department may take 4–8 weeks. Incomplete submissions or requests for additional documents will extend the timeline. We work to ensure your application is complete before submission to minimise delays.

Question 4

What documents are required for an Employment Pass application?

Accepted Answer

Core documents typically include: the applicant's passport (valid for at least 18 months), academic certificates and transcripts, a detailed CV, the employment offer letter or contract, the company's registration documents (SSM), the company's latest audited financial statements, and the expatriate post approval letter. Additional documents may be required depending on the industry, company type, and the applicant's nationality. We provide a tailored document checklist for every client.

Question 5

Can my spouse and children accompany me on an Employment Pass?

Accepted Answer

Yes. Dependant Passes can be applied for spouses and unmarried children under 18 years of age. The Dependant Pass is tied to the principal EP holder's pass validity. Spouses on a Dependant Pass may apply for a separate Letter of Approval to work in Malaysia, subject to approval.

Question 6

What is a Professional Visit Pass (PVP)?

Accepted Answer

A Professional Visit Pass (PVP) is issued to foreign nationals who are employed and paid overseas but are temporarily assigned to work in Malaysia for a specific project or assignment. It is not an employment pass — the holder remains on the payroll of their overseas employer. PVPs are commonly used for project-based assignments, technical specialists, and intra-company transfers where the individual is not taking up local employment.

Question 7

How long is a Professional Visit Pass valid?

Accepted Answer

A PVP is typically issued for up to 12 months and can be renewed, subject to the ongoing nature of the assignment and Immigration Department approval. The total duration of a PVP assignment is generally capped, and extensions beyond the standard period require strong justification.

Question 8

What documents are needed for a PVP application?

Accepted Answer

Required documents generally include: the applicant's passport, a letter from the overseas employer confirming the assignment and continued overseas payroll, a letter from the Malaysian host company confirming the nature of the project, the applicant's CV and relevant qualifications, and the host company's registration documents. We will provide a complete checklist based on your specific situation.

Question 9

When should I start the renewal process for an Employment Pass?

Accepted Answer

We strongly recommend initiating the renewal process at least 3 months before the current pass expires. This allows sufficient time to gather updated documents, obtain any necessary approvals, and submit the application without risk of a lapse in the employee's legal work status. Working on an expired pass is a serious compliance breach with significant legal consequences for both the employer and employee.

Question 10

What happens if an Employment Pass expires before renewal is approved?

Accepted Answer

If the pass expires before the renewal is approved, the employee is technically no longer authorised to work in Malaysia. This can result in fines, detention, or deportation for the employee, and penalties for the employer. In some cases, a Special Pass may be applied for as a bridging measure while the renewal is pending. We advise clients to begin renewals well in advance to avoid this situation entirely.

Question 11

What are the employer's compliance obligations for expatriate employees?

Accepted Answer

Employers are responsible for ensuring all expatriate employees hold valid passes at all times, notifying the Immigration Department of any changes in employment terms (salary, designation, or company), cancelling the pass promptly upon resignation or termination, and maintaining accurate records of all expatriate staff. Failure to comply can result in fines, blacklisting, or suspension of the company's expatriate quota.

Question 12

Can an Employment Pass be transferred if an employee changes employer?

Accepted Answer

No. An Employment Pass is tied to a specific employer and cannot be transferred. If an expatriate changes employer, the current pass must be cancelled and a new application submitted by the new employer. The employee may need to exit and re-enter Malaysia depending on the circumstances. We manage this transition process to minimise disruption.
